In many states and courts, yes — you must show you demanded payment before filing, and some small claims forms ask when and how you did. Why does the letter cite my state’s statute?

Citing the exact statute tells the landlord you know the specific law they violated — not just a vague sense of unfairness. Should the letter threaten extra damages?

It can mention them accurately. Many states penalize bad-faith withholding with double or triple the deposit, and the generated letter references "additional damages the law allows" — a truthful, calm formulation. Never exaggerate or invent amounts: a letter that overreaches reads as a bluff and can undermine you in court.

What if I only got part of my deposit back?

Demand the remaining balance. Enter the amount still owed rather than the original deposit, and keep the landlord’s partial payment and any itemized statement they sent — the dispute is then about whether the withheld portion was lawful, which usually turns on damage versus normal wear and tear.
